Some Help
Hello everyone i am new to this forum. I am hoping someone can give me some advice. I have always had good credit, always paid my bill on time. My credit score has always been 715 and up. One day in September I got a letter from a collections agency about a credit card that had gone into collections. I was dumb founded. I filed a police report and found out it was my brother who stole my identity and opened up a credit card and never paid it, he charged about 3500k. The collections agency investigated it and found i was not the responsible party. I went back to the original credit card company which was GEMB/ACCC and told them the story and they said there was nothing they can do about it. I continue to fight with them and they wont even talk to me now. I got the collections agency account cleared from 3 of my credit profiles and the original credit card from 1 of them, but still shows up on the other two. Any advice??? My credit stands at 644, 659 and 712.

Just continue to send dispute letters where the account remains on reports, challenging them to prove that the account is yours. The burden of proof for reporting purposes is on the credit bureaus. If they can't prove it is yours, they can't report that it is. It's that simple.

reply to Some Help
You need to keep on the credit bureaus to get thing resloved. Then go back to GEMB when that is done. They will reveiw your credit report and make changes.

GEMB/ACCC refuses to do anything for me except tell me the information is correct and they can do nothing about it. If i claimed fraud before it went to collections than they would probably be able to do something about it, problem is i didnt know about this account until it went to collections. GEMB/ACCC are ignorant to the fact that this information is inaccurate. THe name on the account doesnt matche my SSN, the first and last name is correct but they have a suffix at the end, the address on the account also doesnt match my address. I was told i am spinning my wheels

One way or another, you will get this thing fixed Frdtrtnfx4. Don't worry too much - it might just take a while and be a pain. But, you are on solid ground as the debt was fraudulently taken out in your name. Ultimately, that means you'll be okay. Just keep at it.

I think Magic69 may be correct. But stay on top of everything! The credit bureaus is the main one. It will take some time to resolve for sure. GEMB has alway giving me problems for my clients. There is a huge lack of customer service in their customer service dept. You end up talking to someone overseas and they just hand over the phone a budy acting like some manager. I would write letters and fax papperwork also to leave a papper trail to all parties also. Document everything phone call, fax and mail.

Do the credit bureaus have the authority to delete information from my credit profile without verifying the information with the creditor? Say if they have enough information to believe that the information is inaccurate, can they delete it? I have papers showing i am not the responsible party and such.

Short answer: yes. They actually can't (by law) report things that are inaccurate and the burden of proof is on them. If you have documents proving what they are reporting is inaccurate, they have to stop reporting those things.

Thanks magic69, you seem to be very knowledgable in regards to this stuff. Experian deleted this without verifying it with the original creditor. I called them and spoke with a lady and told her i mailed in a letter, she confirmed they received it and 2 weeks later it was deleted off my profile. The problem with transunion and equifax is they continue to go to the oringal creditor and have the information verified as accurate. They say they cannot accecpt the letter i continue to send them. What should i continue to try and do? Once again thank you for your help. I will not stop fighting this until this is deleted from my credit profile.
