    Default Filed Bk Chapter 13 buts wants to sell

    Good day to all! I filed chapter 13 3 months ago but wants to sell the house. Do to the market I am upside down by 30k. Would a bank allow a short sell? Owe 175k should appraise $150 +/-. Anybody know if a short sell will go through? Will the courts allow this?

    Short answer: yes, as long as it makes more sense for the bank to short sell than foreclose, which is probably the case.

    Why not just do a ch. 7? For the most part, a ch. 13 and ch. 7 are nearly the same to your credit. From 1-10, 10 being the worst, a ch. 7 is a 10 while a ch. 13 is a 9. You can dump the house with a ch. 7 instead of having a ch. 13 and a short sell on your report.
